APG, LLC (“APG”) takes your privacy seriously. This Privacy Policy (“Policy”) is intended to provide you with information regarding APG’s collection, storage, use, and disclosure of your personal information (“Information”). This Policy applies to APG.com, as well as any other website owned and controlled by Atlanta Partners Group and its affiliates, and all websites that link to this Policy (collectively, the “Site”), and to all services available on the Site. By using the Site, you consent to the collection and use of your Information by APG as described in this Policy.

SCOPE; THIRD PARTY SITES

This Policy applies only to Information we collect at and through the Site. Our Site may contain links to third party websites (including the link to the investor portal owned and controlled by third party (“Investor Portal”)) or services that are not owned or controlled by APG. Please be aware that we are not responsible for the privacy practices of such other sites or their services. We encourage you to be aware when you leave our Site and to read the privacy statements of each and every website that collects personal information.

CHANGES TO OUR POLICY

We may update this Policy from time to time. We will not reduce your rights under this Policy without notice to you, or without your consent, where required by applicable law. We will post any Policy changes on this page and, if the changes are significant, we will provide a prominent notice as we deem appropriate. We will also keep prior versions of this Policy in an archive for your review.

INFORMATION COLLECTED

APG collects certain information when you inquire about our EB-5 projects and our services, when you communicate with us, when you use our services, when you interact with us through social media, and when you visit our Site. We seek to limit the collection and use of information required to deliver our services, which includes advising you about our EB-5 projects, services, and other opportunities, and to provide our services and administer our business.

Information You Provide to Us When you Use our Site.

Although in most cases you are not required to share Information with us when you use Contact – APG page on our Site, you may provide the following Information to us:

    • First and last name

    • Email address

    • Phone number

    • The content of any message that you send to us through the “Add a comment” box.

When you use the Investor Portal, we collect your first and last name, email address, phone number, and location details in order to set up your account on the Investor Portal. You may optionally also provide your phone number to enable multi-factor authentication. You may update certain contact details, bank account details, and address through the Investor Portal, such as your mailing address. Additionally, you may have the option to establish a direct relationship with our Investor Portal provider. In such cases, your relationship with the portal provider is independent and is governed by the Investor Portal provider’s applicable terms and privacy policy.

Information We Collect Automatically

As is true with most websites, we collect certain information (some of which may be considered “Information” under certain privacy laws) automatically when you use our Site, such as:

    • IP address.

    • Browser type.

    • Computer or device type.

    • Unique device identifiers for mobile devices or tablets.

    • Operating system version.

    • The website from where you navigated to our Site.

    • Time and date of using, accessing, or otherwise interacting with our Site.

    • The pages on our Site that you view, any search terms that you enter, and how you interact with our Site.

    • The name of your Internet service provider.

We collect and use the Information so that we can provide services to you and provide information that you request from us. This includes:

    1. Respond to inquiries and questions, communicating with you.

    1. Providing information about our EB-5 project, properties and our business.

    1. Provide services such as tenant services, agent services, investor relationship services associated with our EB-5 projects.

    1. Verify your identity, contact information, investor status and employment.

    1. Operate and manage your Investor Portal.

    1. Resolve disputes, address complaints and troubleshoot technical problems.

We may also use your Information to: (i) analyze, operate and improve the Site, our services, and our business; (ii) customize the content you see when you use the Site, or the services that we offer to you; (iii) conduct market analysis, traffic flow analysis and related reporting to third parties; and (iv) for any other purposes disclosed to you at the time we collect your Information.

We may also use Information as we believe may be necessary or appropriate for certain essential purposes, such as: (i) to comply with applicable law and legal process; (ii) to respond to requests from public and governing authorities; (iii) to detect, prevent, or investigate potential security incidents or fraud; (iv) to enforce our Terms of Service or any other contract; (v) to protect our operations or those of our affiliates; (vi) to protect our rights, privacy, safety, property, security and/or that of third parties; and (vii) to allow us to pursue available remedies or limit the damages that we may sustain.

Any information that we collect that does not constitute “Information” (meaning, it is not personal information and cannot identify you), may be used and disclosed by Atlanta Partners Group without restriction of any kind. Additionally, we may de-identify Information so that it no longer identifies you (and is no longer considered “Information”), which we also may also use and disclose without restriction.

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

ADVERTISING

We may use how you browse our Site in order to show you ads for Atlanta Partners Group or our advertising partners that are more relevant to your interests. We may use cookies and other information to provide relevant interest-based advertising to you. Interest-based ads are ads presented to you based on your browsing behavior in order to provide you with ads more tailored to your interests. These interest-based ads may be presented to you while you are browsing our Site or third-party sites not owned by APG.

HOW WE SHARE YOUR INFORMATION

We share your Information with our third-party service providers who provide services to us, such as website hosting, data analysis, analytics, marketing, IT services, email delivery services, and other services, in order to enable them to provide such services.

We may share your Information as necessary for the essential purposes described above and in other contexts with your consent.

Your Information may also be disclosed to a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, or assets (including in connection with any bankruptcy or similar proceedings).

ACCESS TO YOUR INFORMATION AND CHOICES

You can access, update, or delete certain Information we have about you by contacting us at contact@APG.com. You can opt-out of receiving marketing and promotional e-mails from Atlanta Partners Group by using the opt-out or unsubscribe feature contained in the e-mails.

SECURITY OF YOUR INFORMATION

APG uses commercially reasonable measures to protect the confidentiality and security of your Information. However, since the Internet is not a 100% secure environment, we cannot guarantee, ensure, or warrant the security of any Information you transmit to us. There is no guarantee that information may not be accessed, disclosed, altered or destroyed, or that Your Information won’t be intercepted while being transmitted, by breach of any of our security measures.

CHILDREN’S PRIVACY

The Site is directed to persons 18 years of age or older and you must be 18 years of age in order to access the Site. If you are under 18 years of age, please do not access the Site or provide any Information about yourself to us. Atlanta Partners Group does not knowingly collect or solicit any Information from persons under 18 years of age. If Atlanta Partners Group becomes aware that a child under 18 years of age has provided Information to APG, Atlanta Partners Group will delete such Information.
