Hidden Hills Vistas, a 95-unit luxury cabin development, already in active construction, in Gatlinburg, Tennessee is EB-5 project in a rural targeted employment area (TEA). Because the project is in a Rural TEA, the minimum investment amount is $800,000 instead of $1,050,000. This project offers investors many key features, including a job creation buffer of roughly 20% per investor and priority I-526E petition processing.

EB-5 Investment as a First Lien Lender
The EB-5 investment has two major advantages. First, it has the most secure repayment position as a First Lien Mortgage with the land as collateral and security upon repayment of bridge financing. Second, the initial term is only 3 years and, if extended by the Borrower, the preferred return to the investor increases from 1% to 3%.
Completion Guaranty
The Sponsor, having deep EB-5 experience and confidence in this project, has issued a Completion and Performance Guaranty. This Guaranty gives the investors the confidence that the project will be delivered as designed and on time. Further, through this Guaranty, the investors are assured that the Sponsor will abide by all terms and conditions in the offering documents.
Priority I-526E Processing
Because the Hidden Hills Vistas project is located in a rural TEA, USCIS will prioritize investors’ I-526E petitions. By investing in a rural project, investors qualify for priority processing of their I-526E petition. Based on our observations, recent adjudications by USCIS suggest that investors can anticipate their I-526E petition being processed between 6-9 months. Investors who invest in rural projects benefit from the visa set-aside, which reserves 20% of the EB-5 Program visas for their use (source: USCIS). I-526E Denial Refund Guaranty

- Guarantee of Investment Return: The Guarantor irrevocably guarantees the return of an investor’s capital contribution if the USCIS denies the Company’s I-956F petition or the investor’s I-526E petition, under certain conditions.
- Conditions for Refund:
- Refund is triggered by USCIS’s final denial after all administrative remedies are exhausted, excluding judicial actions.
- The denial must be related to deficiencies in the project, not to the investor’s personal background or legal issues.
- Exclusions from Guaranty:
- No refund for denials due to ‘Bad Actor Reasons’ which include involvement in illegal activities such as fraud, terrorism, or money laundering.
- Repayment Prioritization:
- In scenarios with multiple investors, repayments are adjusted prioritizing the investor whose capital was received first.
JCE Construction and Performance Guaranty Summary:
- Comprehensive Guarantor Commitment: Mr. Durga Prasad Gadde, the JCE Principal (“Guarantor”), ensures the completion of the Project as per the terms outlined in the Offering Documents. This includes fulfilling financing needs either through additional capital contribution, securing subordinated debt financing, or selling assets like cabins to finance construction.
